Hollilander – Terms & Conditions for application

1. Introduction

These Terms & Conditions govern your access to and use of the Hollilander mobile and web  applications, websites and related services (the “Service”).

By creating an account, clicking “I agree” or using the Service, you agree to be bound by  these Terms. If you do not agree, do not use the Service.

These Terms incorporate the Privacy Policy and any assignment‑specific terms we present  for particular features or client engagements.

2. Who We Are

Hollilander Limited (“Hollilander”, “we”, “us”) operates the Service for healthcare staffing. Contact: agencyworkers@hollilander.com

3. Status & Assignments

You are engaged by Hollilander to complete temporary assignments for client facilities.

Unless otherwise stated in your written contract, you are an employee of Hollilander for  payroll/tax purposes when working Hollilander‑booked shifts.

Nothing in these Terms creates an employment relationship between you and a client  facility. Each assignment is separate, and there is no guarantee of minimum hours.

4. Eligibility, Right‑to‑Work, Vetting & Training

You must be 18+ and legally entitled to work in Ireland. You must maintain valid  right‑to‑work, Garda Vetting, required immunisations, and current training

(e.g., Manual Handling, People/Patient Moving & Handling, Safeguarding) as required by  client policy and law.

You authorise verification of identity, immigration status, credentials and training with  issuing bodies and screening providers.

You must keep your account details accurate and secure, use multi‑factor authentication if  requested, and notify us immediately of any change in status (e.g., visa expiry, professional  sanctions, health restrictions).

We may limit access or suspend bookings where requirements lapse.

5. Scope of Services

The Service enables Agency Staff to view/accept shifts, clock in/out, record timesheets and  view pay information; and enables Client users to request, confirm and approve shifts.

We integrate with payroll and tax systems for compliance. Nothing guarantees minimum  shifts or income.

6. Scope of Practice & Clinical Conduct

You must work within your role and competence (e.g., HCA) and follow client policies,  supervision instructions and care plans.

Do not perform duties reserved to higher clinical grades unless qualified, authorised and  scheduled to do so.

Report incidents or near‑misses promptly to the client and to Hollilander.

7. Working Time & Rest

You agree to accurately record hours worked. Hollilander monitors compliance with the  Organisation of Working Time Act 1997 (e.g., daily and weekly rest).

We may limit bookings to ensure legal rest is observed.

8. Shift Posting, Allocation, Cancellations & No‑Shows

Clients may post shift details. A booking is confirmed when shown in‑app or by message.

If you cannot attend, cancel as early as possible and always before start time. Repeated late  cancellations or no‑shows may lead to suspension of booking privileges or termination.

Clients may cancel at short notice; Hollilander is not liable for lost earnings where a client  cancels, unless a fee is provided in a specific agreement.

9. Timekeeping, Location & Audit

You must clock in/out via the App at the client site. The App may capture a point‑in‑time  device location at clock events to validate attendance (subject to device permissions).

Request corrections promptly if there are errors. Clients approve timesheets; approved  timesheets are the basis for payroll.

We maintain audit logs (timestamps, device metadata) and may share records with clients  to resolve disputes or meet compliance requirements.

10. Rates, Premia, Deductions & Payroll

Rates (including any Sunday/unsocial hours premia) are displayed in the App or notified  per assignment and may vary by role, location and timing.

Payroll is processed in line with Revenue (PAYE/USC/PRSI) and your Revenue Payroll  Notification (RPN). If no RPN is available, emergency tax may apply until resolved.

Lawful and agreed deductions (e.g., Revenue instructions; on‑demand wage advances;  replacement costs for unreturned equipment with prior notice) may apply and will be  itemised on the payslip.

11. Uniforms, ID & Equipment

Hollilander‑issued items (e.g., uniforms, badges) remain Hollilander property and must be  returned on request.

You must keep items secure and use them only for assignments. You authorise reasonable  deductions for unreturned or damaged items (fair wear and tear excepted), subject to prior  written notice.

12. Safeguarding, Dignity & Whistleblowing

You must uphold safeguarding standards and report any concerns regarding service users  or staff.

Harassment, discrimination or bullying is prohibited. Concerns may be escalated via  Hollilander’s whistleblowing route without retaliation.

13. Your Device (BYOD) & Security

If you use your own device, keep it secured (screen lock, updated OS), use the App only with  your account, and report loss/theft immediately.

Do not share credentials or allow others to access your account. Hollilander may require  re‑authentication or block compromised devices to protect the Service.

14. Data Protection

We process personal data as described in our Privacy Policy (see the App or  www.hollilander.ie/privacy).

By using the Service you acknowledge the purposes and lawful bases described there,  including the use of clock‑event location for attendance validation.

You can control app permissions in your device settings; some features may be unavailable  if disabled.

15. Non‑Solicitation / Non‑Circumvention

For 10 months after your first Hollilander‑booked shift at a client site, you will not accept  direct engagement by that client (or its group) outside Hollilander without our written  consent.

This does not restrict lawful transfers under a client’s formal conversion scheme, where  applicable fees are paid to Hollilander.

16. App Platforms & Permissions

Apple/Google are not parties to these Terms and have no obligations to provide support.

Apple and its subsidiaries are third‑party beneficiaries of the iOS App; upon your  acceptance of these Terms, Apple shall have the right to enforce them against you.

The App may request Location, Camera, Photos/Files, and Notifications permissions; some  features may be unavailable if disabled.

17. Compliance with Law (Sanctions & Anti‑Bribery)

You will not use the Service in violation of export controls or sanctions. Offering or  accepting improper payments or gifts in connection with assignments is prohibited;

modest customary hospitality must not influence care or allocations.

18. Complaints & Escalation

For shift or payroll issues, contact agencyworkers@hollilander.com. Escalations:  agencystaffing@hollilander.com.

We aim to acknowledge within 2 business days and resolve within 10 business days where  possible.

19. Suspension, Termination & Effects

We may suspend or terminate access for: falsifying timesheets/locations; safeguarding  concerns; repeated no‑shows; loss of right‑to‑work; refusal to follow lawful and safe  instructions; or misuse of the Service.

You may stop using the Service at any time. Obligations accrued before termination remain.  Certain provisions survive termination.

20. Warranties & Disclaimers

The Service is provided “as is” without warranties beyond those required by law, and no  guarantee of shift availability or rates.

We do not guarantee uninterrupted access and may modify features from time to time.

21. Limitation of Liability

To the extent permitted by law, we exclude indirect or special damages and cap aggregate  liability at the greater of €500 or fees paid by you to us in the prior 12 months.

Nothing limits liability for death or personal injury due to negligence or for fraud.

22. Indemnity

You agree to indemnify Hollilander for losses arising from your breach of these Terms,  misuse of the Service, or violation of law or third‑party rights.

23. Order of Precedence & Survival

If any assignment‑specific terms conflict with these Terms, the assignment terms apply for  that assignment only.

Clauses on intellectual property, data protection, non‑solicitation, liability, indemnity and  dispute resolution survive termination.

24. Pay Scales & Incremental Credit

Placement on pay scales and incremental credit (if applicable) are determined under  Department of Health/HSE rules and Hollilander’s published Increment & Placement Policy.

25. Electronic Communications & Signatures

By creating an account, you consent to receive electronic communications and to the use of  electronic signatures and records.

We may send legal notices electronically to your registered email.

26. Changes to the Service & Terms

We may modify the Service and these Terms. Material changes will be notified in‑app or by  email. Continued use after the effective date means acceptance.

27. Governing Law & Venue

These Terms are governed by Irish law; the courts of Dublin have exclusive jurisdiction.  Support and complaints: agencyworkers@hollilander.com
